Booking Terms

These Booking Conditions, together with our privacy policy any other written information we brought to your attention before we confirmed your booking, set out the details of your booking with Luxury Private Chef - Sole trader registered to HMRC at: 5 Park Close, Kinlet, Shropshire, DY12 3BG (“we” or “us”). Please read them carefully as they set out our respective rights and obligations. In these Booking Conditions references to “you" and "your" include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.   

By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that: 

1.     He/she has read these Booking Conditions and has the authority to and does agree to be bound by them;

2.     He/she consents to our use of personal data in accordance with our Privacy Policy on our website and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);

3.     He/she is over 18 years of age and resident in the United Kingdom (if you are not a resident of the United Kingdom, you must advise us prior to booking) and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services;

4.     He/she accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking. 

The agreement will start on the date that is written on the contract and will continue until the date set out in the schedule unless ended earlier. If further services are required after end date, a new agreement will be made following a new contract. The relationship between the client and the contractor will be that of “independent contractor” which means that the contractor is not the client’s employee, worker, agent or partner. Exceptions are made when overseas contracts are made. The client must agree that works can be delayed on the day and menus can be changed if provisions were not available. Luxury Private Chef or the sub-contractor is responsible for food related issues, if the client is not happy or a case of food poisoning occurs; matters will be dealt with between the client, Luxury Private Chef and the sub-contractor to ensure issues are resolved. If the client is not happy with the work after the service has been provided, then a written letter must be sent to us within 30 days. Remedial works may be carried out after if necessary.
 

​Payment & Services:
When booking Chef Joshua Jennings-Todd, a deposit of up to 50% plus booking fees are charged to the client and must be paid within 48hrs of the invoice being produced to secure the booking, after the services are finalised. Bookings made within 7days of occasion a deposit of 75% is to be paid within 24hrs of invoice being produced. The total remaining amount will be made either payable prior, on the day or following your occasion and to be paid by the date stated on invoice. In some cases, additional costs for client requests are needed up front for supplies. Late payment fees of 5% per week will incur. When hiring a private chef, fees will apply for all travel costs (including flights and accommodation if required) and all food costs as well as the hiring service which will be added to the invoices (receipts provided on request). A discretionary gratuity (of labour costs unless priced per head) can be added to the final invoice and is divided equally between the team, this can be removed if any cash has been given on the day. Final costs can vary depending on the menus chosen, cost of ingredients at the time, staff needed, and miles travelled. There are daily, weekly & monthly rates depending on the service required. When acting as an agent and placing a sub-contractor for the position. The deposit for the sub-contractor of up to 100% is required and sent to the sub-contractor once funds have cleared from the client to Luxury Private Chef.
When acting as an agent for placing candidates for temporary or long-term positions, if contracts are agreed between client and candidate, fees to Luxury Private Chef must be paid within 48hrs once the invoice has been produced. If the candidate is unsuccessful within 21 days’ work, either you have the option for me to find you a replacement or the placement fees will be refunded minus the booking fee. After 21 days, we are not liable for any refund. In some cases, if a serious issue has occurred, please send us in writing your dispute and we will review your matter to see if we can assist. When placing candidates, Luxury Private Chef are not liable for any damage, loss or cost expense resulted from the candidate towards the client.
For temporary and full time placement bookings, clients are to pay the candidate directly after the deposit.
Additional charges apply for temporary/long term placement bookings to the client;
Single occasion bookings 15% which will be included in the price plus booking fees and any additional property fees.
2+ days 20% of the contractor/candidate accumulated gross salary for that term plus booking fee and any additional property fees (increased charges can be applied depending on requirements).
Full time placements anything 6 months or over 25% of 1 months’ salary plus booking fees.
Payments are preferably made via BACS, details will be on the invoice. We can also take card payments on request with a surcharge of 3 %.

When placing candidates for short/long term positions, we ensure that we find the best possible person for the position, we conduct interviews and ask for background information. Although we make every effort to verify the candidate, you have the option to conduct your own investigations. 

Client Cancellation Fees:
In the event of a cancellation, the following charges will apply:
Up to 7 days before - deposit, plus supplies, ingredients or travel costs that have already been purchased for the occasion that are non-refundable from suppliers (receipts can be provided on request).
7 - 30 days - deposit or if cancelled due to unavoidable circumstances an option to re-arrange your booking will be offered.
Full refund of deposit prior 30 days except on Christmas Eve & Day, Boxing Day, New Years Eve & Day.
Booking fees are non-refundable. If bookings are made last minute a new agreement for payments and fees will be made in writing.

Usual details of work:
Services primarily are of private chef hire, cooking in a private location of the client’s requirements. Other duties involved are as followed: provisioning, transporting of foods, due-diligence, serving, cleaning, client interaction and to ensure hygiene, health and safety working practices are met. 
We try to use local suppliers where possible for the best produce as well as specialist suppliers and local supermarkets. 
Areas of preparation will be carried out at the location as well as the contractor’s home. If the client is asking the contractor/sub-contractor to carry out such duties outside of the written contract, a new agreement must be made.

Booking details:

Full details of service confirmed in emails including date of booking, location of occasion, how many guests, allergies/dietaries, and any other information necessary.
Estimated totals can vary dependent on if any menu/number changes/staff needed.
This contract also applies to all future bookings made between Luxury Private Chef and the new client, details of future bookings will vary and be specified in emails. A booking confirmation with details will be sent out shortly following the completion of the contract and deposit paid.


Property:
Luxury Private Chef and contractors will be using some of the location’s tools and equipment as well as their own to carry out the work. We will sometimes be using some of the client’s plates, cutlery, and glasses unless over wise stated, if the client requires such items, additional charges will apply for hiring equipment fees. The client must provide safe and appropriate working conditions. Luxury Private Chef contractors/sub-contractors must respect the client’s property, privacy and is responsible for any damage caused in the location or equipment within their control. For your health and safety, Joshua Todd at Luxury Private Chef holds a personal liability insurance certificate. It is advised for the client to request sub-contractor’s personal liability insurance documents before the occasion, and it is at the client’s risk if the contractors/sub-contractors do not hold one. Luxury Private Chef contractors/sub-contractors must provide their own uniform, knives and is responsible for their own hygiene, health, and safety. Clients must inform us of all allergies and dietary requirements of guests at the property prior to the occasion, we are unable to cater for people with airborne allergies as dishes are prepared in a kitchen where various ingredients are present. If we are not informed of an allergy and a guest has an allergic reaction, we will not be held liable for the outcome. If allergies and dietaries are presented to us on the day of your occasion, we will do our best to provide a service for the guests but cannot guarantee we can meet the demand.

Bookings:
Booking can be made directly through us or our affiliated partner 'Sierra Retreats'.
After signing and retuning this form to us you agree with our terms. The privacy policy, booking terms & conditions can change from time to time. Please see our website for updates at:

Only once all parties have signed this contract, the contract is then binding. If the client does not pay Luxury Private Chef, we must receive in writing an explanation from the client why or legal action will be taken to resolve payment.
In the unlikely event that Luxury Private Chef for any reason needs to cancel your booking you will be offered a full refund on the service and discounted on your next booking. Any sub-contractors must pay in full the funds back and provide reasons for cancelling in writing. In some cases, we may have to change contractors or sub-contractors depending on their availability.
The sub-contractor has agreed to be honest and inform Luxury Private Chef if the client tries to work directly with them and not to go directly to the client or the property owner for work within 12 months of the date stated by Luxury Private Chef on this contract. As with the client, by signing this they agree not to go directly to the sub-contractor without contacting Luxury Private Chef in advance.

Information that you provide to us when visiting on our website, completing an online enquiry form, an online or offline booking form, filling, subscribing to mailing lists, entering competitions, participating in market research and when contacting us both on and offline including:

  2. Demographic information such as preferences, interests, age and family information.

  3. Information relating to your booking such as feedback questionnaires, reviews, image or video uploads, enquiries and marketing requests.

  4. Information relating to quoting and booking including information relating to family and friends such as names, emergency contacts, any allergies or dietary restrictions (which may disclose your religious beliefs) country of residence and nationality.\

  5. We do not store financially sensitive information such as credit card numbers, bank details or security numbers.

  6. Information automatically received by us when you use the website, access our marketing information or contact us by email or phone including such as browsing and search history. We may also use industry standard software tools such as Google Analytics to measure and collect session information, time visiting specific pages, page interaction and repeat visits.

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Throughout our website and social media we emphasise Michelin standard, while we say we aim to produce to this standard we are not Michelin starred or rated from the company.

In order to maintain and understand our data as accurately as possible to give you the best possible guest experience, we may occasionally use the services of external specialist companies for data cleaning and data analysis. Data is protected by a non-disclosure agreement and data is not stored after any work has been completed.

Please be aware that due to the nature of our business and of the internet, information and data you provide may be transferred outside the country where it is submitted to us. If you are submitting information or data from a country within the European Economic Area (EEA) it is possible that it may be transferred outside the EEA, where data privacy regulations may differ from within the EEA.

We will not sell your personal information to third parties unless we are required by law to do so.

We are ensuring health, safety and hygiene procedures is being met to the highest standard (as always) more so in these times by wearing masks and gloves when necessary and respecting distancing with the clients. If you have to cancel due to Covid-19 we will aim to reschedule your booking. 

Joshua Todd founder of Luxury Private Chef is fully vaccinated and takes lateral flow tests when necessary to ensure the safety of himself and others around him. If you would like your private chef or server to present a lateral flow test before your occasion please let us know so we can arrange this.
