BOOKING TERMS & CONDITIONS
Luxury Private Chef T/A Joshua Jennings-Todd

These Terms & Conditions, together with our Privacy Policy and any written correspondence issued prior to confirmation, form the agreement between Luxury Private Chef (“we”, “us”, “our”) and the Client (“you”, “your”).
By making a booking, the first named person confirms they:

Have read and agree to be bound by these Terms.

Have authority to act on behalf of all persons included in the booking.

Accept full financial responsibility for the booking.

Consent to our use of personal data in accordance with our Privacy Policy, including disclosure of relevant health or dietary information.

Are over 18 years of age.
1. NATURE OF AGREEMENT
The agreement commences on the date stated in the booking confirmation and continues until completion of services, unless terminated earlier in accordance with these Terms.
Luxury Private Chef operates as an independent contractor. Nothing in this agreement creates a relationship of employment, partnership or agency between the Client and Luxury Private Chef.
Where we act solely as an agent in placing a sub-contractor or candidate, this will be clearly stated in writing.
2. SERVICES
Services may include (but are not limited to):

Private chef services at client premises

Menu planning and provisioning
-
Food preparation
-
Service and guest interaction
-
Kitchen clean-down
-
Temporary and permanent chef placements
Full details of each booking (date, location, guest numbers, dietary requirements, staffing, menu and agreed fees) will be confirmed via email and/or invoice.
Changes to guest numbers, menu, staffing or hours may result in revised pricing.
If service hours exceed the agreed schedule, overtime charges will apply.
We reserve the right to amend menus where ingredients are unavailable or of unsatisfactory quality. A suitable alternative will be provided.
3. ALLERGIES & DIETARY REQUIREMENTS
The Client must notify us in writing of all allergies and dietary requirements prior to the event.
We cannot guarantee an allergen-free environment. Food can be prepared in kitchens where allergens are present.
Failure to notify us of allergies in advance may result in us being unable to cater appropriately, and we accept no liability where information has not been disclosed.
Airborne allergy requests cannot be accommodated.
4. PAYMENT TERMS
Deposits

A deposit of up to 50% is required to secure standard bookings.

Bookings made within 14 days of the event require up to 100% payment upfront.

Deposits must be paid within 48 hours of invoice (24 hours for short-notice bookings).
Bookings are not secured until cleared funds are received.
Final Balance
The remaining balance must be paid by the date stated on the invoice (prior to, on, or immediately following the event as agreed).
Late payments incur interest at 5% per week.
Additional Costs
The Client is responsible for:

All agreed service fees

Food and ingredient costs
-
Travel and travel time
-
Flights and accommodation where required
-
Equipment hire (if needed)
-
Additional staffing (depending on requirements)
-
Overtime
Certain supply costs may be required in advance.
Prices may vary depending on ingredient costs, supplier pricing, travel distance and final guest numbers.
Payment Methods
Preferred method: BACS transfer.
Card payments available on request (3% surcharge applies).
5. GRATUITY
A discretionary service charge may be added to the final. This is distributed amongst the team. It may be removed if cash gratuity is provided on the day.
6. CANCELLATION POLICY
Client Cancellation
-
More than 56 days prior: Full refund of deposit (excluding booking fees).
-
14–56 days prior: Deposit retained.
-
Within 14 days: Deposit retained plus reimbursement of any non-refundable costs incurred (ingredients, accommodation, travel, supplier costs).
Booking fees are non-refundable.
Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve and New Year’s Day bookings are strictly non-refundable.
At our discretion, rescheduling your booking may be offered depending on circumstances.
7. SUB-CONTRACTORS & PLACEMENTS
Where we act as an agent in placing sub-contractors:

Deposits (up to 100%) are required before confirmation.
-
Funds are held by us and transferred to the sub-contractor when required.
-
We are not liable for acts, omissions, damage or loss caused by the sub-contractor.
Temporary & Long-Term Placements
Fees:
-
Single occasion: 15% of contractor fee (usually included in the price made out to you)
-
2+ days: Up to 20% of accumulated gross salary (usually included in the price made out to you)
-
Full-time (6+ months): 25% of one month’s salary
If a placed candidate leaves within 21 days, we will offer a replacement or partial refund (excluding booking fee). After 21 days, no refund is due.
Clients are responsible for conducting their own background checks if desired.
8. PROPERTY & LIABILITY
The Client must provide:

Safe and hygienic working conditions
-
Adequate kitchen facilities
-
Reasonable access to utilities
We may use client’s crockery, cutlery and equipment unless otherwise agreed.
Luxury Private Chef holds Public Liability Insurance.
Sub-contractors are responsible for their own insurance. It is the Client’s responsibility to request documentation if required.
We accept liability for damage directly caused by our negligence. We are not liable for:

Pre-existing damage

Indirect or consequential losses
-
Loss of profit
-
Guest misconduct
9. COMPLAINTS
Any dissatisfaction must be submitted in writing within 30 days of the event.
We will review and, where appropriate, offer remedial action at our discretion.
10. NON-CIRCUMVENTION
Clients agree not to engage directly with any sub-contractor introduced by Luxury Private Chef for a period of 24 months without written consent.
Sub-contractors likewise agree not to approach clients directly.
11. FORCE MAJEURE
We are not liable for failure to perform due to events beyond our reasonable control, including but not limited to severe weather, illness, transport disruption, supplier failure or government restrictions.
12. OUR RIGHT TO CANCEL
In the unlikely event we must cancel, a full refund of monies paid for services will be provided.
We reserve the right to substitute chefs or sub-contractors of equivalent standard where necessary.
13. GENERAL
These Terms apply to all future bookings unless updated. The latest version is available on our website.
This agreement becomes legally binding once signed and deposit payment is received.
Failure to pay without written explanation may result in legal recovery action.

We are ensuring health, safety and hygiene procedures is being met to the highest standard (as always) more so in these times by wearing masks and gloves when necessary and respecting distancing with the clients. If you have to cancel due to Covid-19 we will aim to reschedule your booking.
Joshua Todd founder of Luxury Private Chef is fully vaccinated and takes lateral flow tests when necessary to ensure the safety of himself and others around him. If you would like your private chef or server to present a lateral flow test before your occasion please let us know so we can arrange this.
